Octapost is a social media management platform that allows businesses and creators to:

  • Compose, schedule, and publish content across multiple social media platforms
  • Manage multiple social media accounts and pages from a single dashboard
  • Collaborate with team members on content creation and approval workflows
  • View analytics and performance metrics for published content
  • Use AI-powered tools to assist with content creation

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach

You must be at least 18 years of age or the legal age of majority in your jurisdiction to use the Service.

4. Social Media Platform Integration

The Service integrates with third-party social media platforms (including but not limited to Facebook, Instagram, X, LinkedIn, and TikTok). By connecting your social media accounts, you:

  • Authorize Octapost to access and manage your connected accounts within the scope of permissions granted
  • Acknowledge that you comply with each platform's terms of service and community guidelines
  • Understand that platform API changes may affect the availability or functionality of certain features
  • Accept that Octapost is not responsible for actions taken by third-party platforms on your content

5. User Content

You retain ownership of all content you create, upload, or publish through the Service ("User Content"). By using the Service, you grant Octapost a limited, non-exclusive license to process, store, and transmit your User Content solely for the purpose of providing the Service.

You are solely responsible for:

  • The legality, accuracy, and appropriateness of your User Content
  • Ensuring you have the necessary rights and permissions to publish your content
  • Compliance with applicable laws, including copyright, trademark, and privacy laws

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purpose
  • Publish content that is defamatory, obscene, hateful, or violates the rights of others
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, data mine, or use automated means to access the Service without authorization
  • Resell, sublicense, or redistribute the Service without written permission
  • Violate the terms of service of any connected social media platform

7. AI-Generated Content

The Service may provide AI-powered features to assist with content creation. You acknowledge that:

  • AI-generated content is provided as suggestions and should be reviewed before publishing
  • You are responsible for all content published through your account, including AI-assisted content
  • Octapost does not guarantee the accuracy, originality, or suitability of AI-generated content

8. Subscription and Billing

Certain features of the Service require a paid subscription. If you subscribe to a paid plan:

  • You agree to pay all fees associated with your selected plan
  • Subscriptions are billed on a recurring basis (monthly or annually) as selected
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • We reserve the right to change pricing with reasonable notice
  • Refunds are handled in accordance with our refund policy

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Intellectual Property

11. Limitation of Liability

To the maximum extent permitted by law, Octapost and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Loss of data, revenue, or business opportunities
  • Service interruptions or platform API outages
  • Unauthorized access to your accounts due to factors beyond our control
  • Content published through the Service that violates third-party rights or platform policies

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to access the Service ceases immediately
  • We may delete your account data after a reasonable retention period
  • You may request export of your data prior to termination
  • Provisions that by their nature should survive termination shall remain in effect

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Octapost operates, without regard to conflict of law principles.
